SAM IP Patents

Patents can be thought of as a contract between an inventor and the public. The inventor agrees to share the technical knowledge he or she has in the invention with the public, as disclosed in the patent, and in turn, the public agrees to grant exclusive right to the inventor to make, use, offer to sell, and to actually sell the patented invention for a term of 20 years. Thus, patents are highly valuable to inventors in that they grant inventors the right to exclude others from practicing the inventor's invention for the patent term. On the other hand, patents are also highly valuable to the public in that they disclose to the public the scientific and technical workings of the invention and thus allow the public to use the newly gained scientific and technical knowledge in their research and development. In other words, patents are a vital tool used to "promote the progress of science and the useful arts." Clause 8 of the Constitution.
